A major component of the ‘new labour’ government and the current coalition government’s radical welfare reforms has been the Work Capability Assessment (WCA) for disabled people. Debbie Jolly co-founder of Disabled People Against Cuts (DPAC) finds that the assessment has been made much more stringent, with people with often multiple impairments being found ‘fit to work’ through the test. If the WCA is not immediately reviewed and rethought, the current system will provide little benefit to employers and will severely reduce the quality of life of many disabled people.
From now until Spring 2014 all those who are receiving Incapacity Benefit, Severe Disablement Allowance and Income Support paid on the grounds of illness or disability will be assessed for Employment and Support Allowance (ESA), undergoing a stringent Work Capability Assessment (WCA) carried out by the French Company Atos who are contracted by the Department of Work and Pensions (DWP).
First introduced in 2008, the much criticised WCA has become even more punitive since changes in the 2011 edition of the training manual for assessors. Pilots in Aberdeen and Burnley have raised more criticisms of the process adding to the raft of criticisms from the British Medical Association, GPs, Citizens Advice Bureaus (CABs), Members of Parliament and disability organisations.
Those going through the test can be put into one of three groups: ESA Support Group not required to undertake work-related activity – but will be reassessed continuously; ESA Work Related Activity Group, for those deemed fit for work with support and preparation. It will be limited to just 12 months before ESA is stopped, and also may be subject to reassessment in the 12 month period; or Fit for Work, not entitled to ESA but transferred to a lower amount on Jobseeker’s Allowance.
The Problems
Case studies have repeatedly shown the inhumanity of a system based on government targets and the pain and misery of the increasing stringency of these tests. One example from the 2010 Citizens Advice Bureau’s report on ESA and WCA testing procedures highlights the experiences that someone considered ‘fit for work’ through WCA might endure:
She was in a great deal of pain in her muscles and joints and had extreme fatigue. At times her balance was affected and she could not walk without someone to support her. Sometimes she lost sensation in her legs, and on her worst days she could not walk at all. Any exertion such as walking 40 or 50 metres led to days in bed. She had had a bad reaction to some of the treatment and an ECG showed her heart muscle had been damaged. Her husband had to come home from work each lunchtime to help her. Her immune system was weakened, so she had to be careful when mixing with others. She claimed ESA but was given six points in the Work Capability Assessment (WCA) and found capable of work. Her doctor supported her claim and she is currently appealing, but under Incapacity Benefit she would probably have been exempt and would have avoided this process.
There are many other stories like this. There are also increasing stories of suicides committed by people left without any means of income fighting and winning appeals, only to find they are called for WCA reassessments shortly after. As part of the recognition of the increasing trend of those going through assessments to take their own lives Job Centre Plus staff have been issued with guidelines on how to deal with people who they think might be suicidal because of the WCA testing.
One estimate claims that up to 500,000 people have been wrongly denied Incapacity status. In the Guardian, Amelia Gentlemen reminds us that since its rollout people with terminal illness have been found ‘fit for work’, those with mental health issues have said the system cannot appreciate complexities of mental health, and others that the tick box system is unable to cope with any nuances of long term impairments or illness.
Citizens Advice Scotland reported that under incapacity benefits, 37 per cent were found ‘fit for work’. Under Work Capacity Assessment, the figure had soared to 66 per cent. In 2008 The DWP and Atos were severely criticised by Robert Martin, the President of the Appeals Tribunal Panel, a position now abolished:
Criticism was made of ATOS Healthcare medical practitioners who did not appear to pay sufficient attention to the appellant at the medical examination and who produced findings in medical reports based on observations that were inconsistent, or recorded in the medical report findings that were contradictory
In a later 2010 independent review of the WCA tests Professor Harrington concluded:
There is strong evidence that the system can be impersonal and mechanistic, that the process lacks transparency and that a lack of communication between the various parties involved contributes to poor decision making and a high rate of appeals.” and that “evidence has consistently and regularly highlighted problems with each stage of the WCA process, which limit both the assessment’s fairness and effectiveness.
Moreover Atos’s own staff have said the assessments are too harsh. Prospect, the trade union who represent 135 Atos doctors, has also stated that the target of seeing ten or more people a day is unrealistic and will lead to wrong assessments, especially in complex cases.
Despite the overwhelming evidence that WCA was not working, Atos were awarded a further 3 year contract by the DWP at the end of 2010, with a contract for £300 million based the perceived expertise of a software system LiMA, which comprises the central part of the WCA testing.
Hidden Statistics
There has been a 56 per cent increase in ESA appeals with figures up from 25,700 in the second quarter of 2009/2010 to 52,000 in the same quarter of 2010/2011. Almost half of cases are overturned at appeal. Paul Hoggarth of Burnley Citizens Advice said that as many as 80 per cent of those supported in their claims to overturn a ‘fit for work’ decision win. Figures from the DWP show that of those declared ‘fit for work’ by the WCA system, just 13 per cent are in employment. The ‘fit for work’ myth does not convert into any form of reality.
A representative survey carried out by Ipsos MORI and reported in ‘Employment and Support Allowance: findings from a face to face Survey’ commissioned by the DWP, found that nearly a third of those going through the WCA process were described as having ‘literacy problems’. A further six per cent ‘problems speaking English’ and 11 per cent had ‘numeracy problems’. Twenty two percent were described as in one or more disadvantaged groups including those with mental health issues, ex-offenders, and those with perceived learning difficulties.
An overwhelming 69 per cent of those going through the WCA process had ‘multiple health conditions’, with 81 per cent of people receiving medical treatment for their condition and 38 per cent waiting for treatment or additional treatment in all ESA groups. These statistics do not present us with a set of fraudsters pretending to be sick or disabled, nor a set of individuals who have been languishing on incapacity benefits for years; in fact 71 per cent of applicants to ESA were new claimants making their first ever claim.
The discredited WCA
The WCA is not really about assessing fitness for work, nor supporting people into work. The ‘capability’ tests were always part of a mutual interdependence between successive Governments’ need to reduce social claims on the state and business identifying financial benefit in such a process. The misery it causes is deemed irrelevant by all parties.
The 2011 manual issued by the DWP to Atos provided new regulations including:
…infrequent loss of consciousness would not substantially impact on a person’s ability to work and therefore only those experiencing weekly or monthly episodes of loss of consciousness will be awarded scoring descriptors.
Thus if you spontaneously lose consciousness once every five weeks, you will be assessed as ‘fit for work’. This is one example of the non reality of new WCA ‘fit for work’ standards. It undermines the logic, and the economic and social realities of any reasonable employment criteria. The WCA is presented under the guise of state and market efficiency. It serves neither criterion.

I have been reading through the comments posted in 2011/12…..and here I am in the summer of 2014 with exactly the same problems. So glad I read through this page though, its a comfort to find other people feeling exactly then same as I do! Could I ever have done more to stay employed, I fought like a mad thing for 2 lumber spine operations and one cervical spine operation. I went through the appeals process to save my NHS job, but failed and was unemployed but waiting for surgery in September 2010. I thought I’d suffered enough but hadn’t allowed for a year long assault delivered courtesy of the Welfare Reforms.
In that time I’ve had all benefit payments withheld for almost 3 months, that was pure hell. I’ve been misled and deceived throughout this nightmare…..and I haven’t told one single fib. That makes me a better (but poorer) person in my book!
My condition has dramatically worsened (cervical spine)due to packing furniture ready for eviction (bedroom tax)…..and now I’m just too tired, too weary to try any more . A note to our selfish and smug politicians…..denying me of the means to survive doesn’t change anything!

I am terrified that I am going to be assessed as fit to work, I awaiting the medical part of the transition to ESA from IB. I am worried that they will expect me to get a jpb even though I have a wheelchair and it is an attendant wheelchair because I am unable to wheel myself around as I have hyper mobile elbows, I am in constant pain I have ostroarthritis in both hips and an imune disorder that affects my whole body I have a peripheral nerves problem and a sleep disorder anongst other illnesses. I worked as a civil servant but was retired on ill health grounds. So if even the civil service wont allow me to work for them because of my illnesses why do they think anyone else will employ me. I would prefer to work than to live in poverty because in this day and age welfare benefits are dire if you do not have children to support. I have worked all my life and have paid my NI I shoudl not have to worry anout things like this which make my illness worse. By all means give me a medical but be realistic about my abilities. I voted for this mad man, beleived he had my best interest at heart, well never ever again….
My mum got the results letter back today and she scored zero points on the test, despite having rheumatoid arthritis, often meaning that she cannot sit down for long periods of time, cannot stand up properly by herself, has trouble getting up the stairs in our house, often finds it hard to use her hands as they frequently lock up, and has to use some sort of support whenever she walks anywhere. Due to the assessment results, things like her disability allowance will be taken away, and we will literally be left with nothing, with the last payment being handed out on 13th February.
Now of course she isn’t the “most disabled” person, nor has she ever for a moment claimed to be, but it makes me think that maybe she should’ve been one of these people that sees a slight pain in their little toe as an inability to walk anywhere and reports it as so. It makes me angry when there are people in our area that receive full benefits when they are perfectly fine. For example, on our street is a women who claims she cannot walk anywhere, is often in chronic pain, seems to develop new illnesses every other month, has been given a car to help her get about, and has to have her daughter as a full time carer, whereas in reality every day she walks about a mile to the shops and a mile back again unhindered, has been seen running, and the only time she sees her daughter is when she travels to her house every weekday to babysit her grandchildren whilst their mother goes to work. And the only person who uses the car is her husband.
I don’t see how people who are awarded full benefits and spend it all on luxuries such as holidays can get away with it, when my mum only receives the minimum amount of DLA and has only ever used it for what it is meant for. I mean, it’s not like she prefers to be on benefits, and I can’t believe how much of the WCA is essentially automated. It wouldn’t have been so bad if my mum had at least been awarded a few points, even if they didn’t mean anything, but for her to be given no points is beyond belief. If I had a job at least I would be able to provide some sort of support, but I have been unlucky in that department so far, and as I am still in further education I guess I would most likely only be able to get a part-time job anyway.
My capability assessment consisted of a woman talking to me for 20 minutes about my home life and my family, she said she was a doctor though no proof was given. How can anyone say what you’re capable of by conversing for a few minutes? There was no medical and no examination.
For a man with knowledge of the profound difficulties that a disabled child had, it is beyond belief that David Cameron can now stop disability payment for others. Our Prime Minister actually claimed these benefits for his own son, even though he is extremely wealthy, having multiple millions. This man is pure evil in his propaganda campaign to smear the vulnerable in the tabloids. He must be having a good laugh at the expense of the poor.
Im going through the problems now(I am partcialy sighted due to cataracts and diabeties type 1 ) I completed the WCA form and they have placed me into a work related group which means i am fit for work which how can you be fit for work if you cannot see and depend on people and software like JAWS to use a computer
My GP told them how the Diabeties keeps me having Hypoglemcemia fits and had 5 comas so far this week. Yet IM fit for work! Goes to show what exactly or whom gets this benefit, If a person like me with tunnelvision cannot get the help just pushed in a que of people why they never brought back the workhouse i will never know.
I have been coping with Spinal Stenosis and secondary Neurological disorders for a number of years. Last year when the first threat wave came to public attention about examining everyone, because of my condition symptoms and the fact that I cannot live without a car, I gave back my Motability car for fear of it being taken away at any time and being left stranded. I have a second hand car which I now pay for with the getting around component. Based on the criteria I have been told about I will not meet the points needed to keep my getting around component and I do not want to be help to wipe my backside and give up independent living which is what the government up to last year encouraged and endorsed through community support structures and GP supervision.
Since then I have acquired a severe anxiety disorder and depression based in acute fear of being stranded with no means to pay for a car and therefore no means to be close to family and friends. My life is in my car. I am now told that if I don’t stop the car to get out and move every so often then I am not disabled and if I can have a conversation on the phone then I am not disabled. I feel this year that what little life force I have left is being squeezed out of me and am just waiting for the phone call ( which I am not supposed to be able to receive) to drive to an examination ( that I am not supposed to be able to attend on time because I should be getting out of my car every 15 minutes to recover)or a letter ( that I am not supposed to be able to pick up ) comes through the door that ( I am not supposed to be able to read) asking me to fill in a questionaire ( that I am not supposed to be able to hold). Frankly I’m so worried that I cannot eat which is actually quite helpful because I shouldn’t really be able to shop/cook/or feed myself , indeed I cont need to worry about the price of food oging up anyway because I can use my T.V. licence money because I’m not supposed to be able to lie or sit in one position to watch a film, or have any quality of life as a person with a disability, who is capable of ‘being’ in the world thanks to the equal opportunities act and with the support of adaptations and medication, one doesn’t need to burdon society with the cost of a carer.
This frankly has plummeted me into further dysfunctional anxiety as I visualise in my mind a quality of life diminishing over the next few years having lost a support system that gave me piece of mind and a simple yet effective lofe style, with no frills or fuss. Future scenarios now flood my mind as I am reaching 60 – that haven’t happened but will and I see myself struggling to get out of the house to do a full time job that I will only manage to attend for about 3 weeks until I fall flat on my face with chronic pain( that I am not supposed to have). Managing anxiety, pain, financial loss and no means to compromise, no grey areas, either a carer for 7 days a week or a full time job.
Where does one’s life go from there…do we get rounded up and marched into a field?
My case highlights many of the contradictions in the WCA system. My husband works, so our income is too high for me to receive ESA payments; the only benefit I get from claiming is that basic national insurance contributions are made on my behalf. The total value of these contributions are around £13 a year. Even if I had managed to fool all the doctors, nurses and other professionals all these years, and the WCA exposed me as that modern folk-devil, the benefit fraudster, it would save the taxpayer very little. ATOS and the DWP have repeatedly refused to reveal how much each assessment costs, but it seems passing unlikely that it is less than £13.

The nurse who performed my assessment was not trained in mental health – ATOS does not employ any mental health nurses, despite “mental and behavioral disorders” being far and away the most claimed for group of illnesses, at around 35% of all claims. This has implications both for the amount of people wrongly deemed able to work, and the amount of people able to fool an untrained assessor into declaring them incapable.

A young lady who is totaly blind, was classed as fit for work because, at her own expence she would go to a local hospital and volanteer on the hospital radio, helping other disabled people, when her local tv found out, they brought her in for an interview, not long after it was aired the DWP reversed thier decision, proving to me that these decisions are not based on any facts, simply based on getting as many people on a lower benifit as possible, this should shame any decent country.
A thing I thought I would never utter. Its not the disabled that are sick it is know the UK that is sick.
Sequel – those that govern us and steal thousands from us in expences are left unpunished ; those that riot and steal hundreds from us are prisoned ; possible something wrong here. Very wrong.
The Work Capability Assessment is, of course, simply the product of minds that are no longer capable of feelings for others, a characteristic which plutocratic neo-liberalism lost thirty years ago.
The interesting feature of the WCA is that it resembles all the other forms of Assessment that render people servile to a tyrannical logic of work mechanisation. Under all these assessments people are coerced into a system that implacably denies the very humanity of people as human beings, it literally dehumanizes those it sorts and allocates. We have seen this in mass education
where intelligent curiosity and a love of learning has been evacuated for the purposes of systemic utility, remaking people in the image of Machievellian plutocrats, demoralizing them and emptying their lives of any significance.
Now they plunder sickness and pain in their depravity to render efficiency the
hallmark of a society these new elites now, almost fully, control.
The last time such a psychotic ruling class ruled in Europe was that of the Third Reich under Adolph Hitler, where millions were forced into a rigorously efficient State machine of which the sacrificial slaughter of outcasts was the cornerstone.
There are too many parallels between Western neo-liberalism and the Nazi
dictatorship for us all to be very concerned, the same psychotic cleavage between
political claims and everyday realities, the same split in the personalities of the political and business class, to their families and friends they are loving parents
and companions but in their workplaces they become psychopathic egotists
cruelly exploiting their power with gusto on the powerless.
No wonder the UK is mired in conflict, if it carries on with this process of demoralization it will undoubtedly, at some point in the future reap the whirlwind.
This Government,does not care about Genuinely Disabled and ill people…I understand Cameron wanting to weed out the ones that pretend to be ill,But he is persecuting everyone…I have seen two cases recently of very ill people being send for work its ridiculous that they cant even stand up for very long…What Cameron is doing it seems for want of better words is almost like an ethnic cleansing of a certain group of people. Cameron says he wants a Big Society…looks like Disabled people are not going to count in his perfect society, Well!! Cameron , here,s the thing , no one is perfect . not even you..What you are doing to Disabled/ill/people is cruel , cold and callous.
