The problem with referenda, writes Jonathan Portes – and especially this one – is that they often present binary choices which do not necessarily reflect voters’ true preferences. This can force politicians to implement policies that are at odds with the will of the majority. He uses the Condorcet paradox to illuminate the difficulty, and asks what it mean for Parliament after the referendum.
Do you prefer wine to whisky, but whisky to beer; and, perhaps, beer to wine? If so, you have intransitive preferences (that is, preferring A to B and B to C does not mean you necessarily prefer A to C. Rock beats scissors beats paper beats rock!). In fact. when it comes to drinking this isn’t really a problem, at least in my experience – context matters – but it is more of an issue with politics and policy. If you said that you preferred David Cameron as PM to Boris Johnson, and Johnson to Jeremy Corbyn, but Corbyn to Cameron, we might conclude that you were more than a little inconsistent.
But that’s not the case for the electorate as a whole. The Condorcet Paradox notes that while each individual voter may have transitive preferences, this may not be true of the electorate as a whole. That is, A may be preferred to B by more than 50% of the electorate, and B to C, but also C to A, without this pattern actually being true of any individual. We may not be inconsistent individually but we can be so collectively.
Normally this situation doesn’t bother us much in our Parliamentary democracy. We elect MPs; the party that gets a majority forms a government, and the government decides between A, B and C. This system may have its own issues, but the paradox either never arises or is at least obscured. But this need not be true of referenda, particularly if it turns out that the subject of the referendum isn’t really a binary choice.
And so it would appear for this one. It has been increasingly clear that there are not two, but three choices in this referendum. Remain in the EU; Leave, and seek to “make our own way in the world”, by negotiating bilateral trade agreements not only with the remaining EU, but with third countries; or Leave, but seek, at least for an interim period, to recreate a large part of the preferential trading arrangements we currently have with the EU, most obviously by joining the European Economic Area. This last is sometimes referred to as the Norway option (or, by its proponents, Flexcit). A clear description of how it might work is here.
Now there are lots of complications here. But for these purposes the only things that really matter (certainly as far as the vast majority of the electorate is concerned) is that what I will call the “straight Leave” option means both that the UK would no longer be part of the Single Market and that we would no longer have free movement with the rest of the EU; while the Norway option would mean that we would retain both.
The proponents of Brexit, and in particular the Vote Leave campaign, had to choose; which Leave option would they advocate? And they faced a dilemma; as my colleague Matt Goodwin has repeatedly emphasised, the risk to the economy from leaving the EU (and excluding ourselves from the Single Market) is by far Remain’s strongest argument; adopting the Norway option might reduce the perceived risk and hence the potency of this issue. But, and ultimately more importantly, immigration and free movement are Leave’s trump cards. They have concluded that by adopting the Norway option, or even allowing it to remain on the table, they would be ruling out the only strategy that gives them any chance of success: concentrating almost all their fire on immigration in the last few weeks of the campaign.
Now suppose they are right, and that, in a straight fight, the electorate do indeed prefer “strong Leave” to “Remain”. What happens next? This is where the Condorcet Paradox comes in. In this case, it would be up to Parliament (with, quite possibly, a new Prime Minister and other ministers) to implement Leave. While Parliament and the government would obviously and rightly be bound by the referendum to negotiate the UK’s exit from the EU, they wouldn’t be bound by anything that Vote Leave had said about how that should be done. With the likelihood of at least some turbulence in financial markets – and, more seriously, with strong pressure from business to resolve the situation in the least destabilising way possible – economic arguments, as well as those of practicality, will come to the fore again.
So, at this point, the Norway option for Leave re-emerges; and, as James Landale has reported, “pro-Remain MPs are considering using their Commons majority to keep Britain inside the EU single market”. Would this be defying the will of the electorate? Not obviously; there would likely to be majority support for such a move. Given a decision to Leave, a majority of electorate would probably prefer the Norway option to “straight Leave” (presumably almost all of those who voted Remain, as well as some of those, albeit a minority, who voted Leave). So there would be nothing obviously anti-democratic about Parliament and Whitehall proceeding on this basis.
But the irony, of course, is that given a straight choice – which, in this scenario, they wouldn’t have had – a majority of the electorate would probably have preferred Remain to the Norway option; indeed, the considerable polling evidence that they couldn’t win on the basis of the Norway option is precisely why Vote Leave chose to rule it out and to focus the campaign on immigration. So the Condorcet cycle is closed; no option is strictly preferred to both the others; and whichever we choose, there’s an alternative preferred by a majority of the electorate.
Where would that leave us? Well, I’ve speculated enough already. But I think there are three key conclusions from this. First, when you’ve got more than two choices, referenda may not be as democratic as they seem. We could easily end up in a place which neither of the campaigns was arguing for. Second, and for obvious reasons, this could be a recipe for continued instability. We may find that, wherever we end up, a majority of us still feel dissatisfied. And finally – a point I’ve made before – that this might be the wrong time to have a referendum; if we’d waited, perhaps we’d have been presented with a genuine clear-cut choice.

I’m not convinced there’s a cycle here. I share the assumptions that Remain would beat Norway and Norway would beat Straight Leave but, for there to be a cycle, we need to think that Straight Leave would beat Remain. I’m not convinced that this is the case. Only 52% voted for Leave and some of those presumably preferred the Norway option to Straight Leave.
I think the problem here is that 52% want to Leave EU, but they want different – inconsistent – things.
Given ‘Remain’, the majority would prefer membership under The Treaty of Rome. A much smaller proportion would like an ever closer union under The Treaty of Maastricht terms
So if the choice were between a either The Treaty of Rome model OR Treaty of Maastricht model and ‘Leave’, a substantially larger majority would have chosen ‘Leave’.
Alex. Ever closer union is in the Treaty of Rome. It’s the first sentence.
And Treaty of Rome was not and could never be any on offer. That door is closed.
The *majority* of the people in the UK people voted to leave the European Union.

No it doss not because there are about 63 million people in the UK and 17.4 million is not even a third and so there was no majority in favour of leave,of any kind.Of course, as a percentage of those who voted there was a 4% majority but for those who either didn’t or couldn’t vote, they are obviously not counted,for some reason,when it comes to being part of the people,whose will is being exalted.Hope that helps and wasn’t too pedantic?l
Wrong. 12.9M did not vote, 16.2M voted remain. 18 M “not eligible”. The majority of the UK did NOT vote leave. Arithmetic 1/10. Must try harder ………
A group of 100 friends are in the noisy, crowded You club. They agree 52-48 that they are not enojying the atmosphere and the DJ didn’t yield to their last ditch request to play more gentle music. So now they are standing as a group outside the door of the club. It’s cold, wet and windy. If they actually bothered to ask, already more than 50 would just want to turn round and go straight back into the You club – it wasn’t that bad and it’s horrid outside. This is the essence of the dialectic – the degree of uncertainty and ambiguity about the precision of the decision is maximal around this 50/50 split.
As the group stand in the rain, they are arguing about which club they should go to next, whether it really is worth the long trek to the Commonwealth club, whether there will actually be anyone else there but them by the time they get there, and it’s been neglected for so long that nobody is certain it’s still open for business. They start to consider the Norway club instead, which is very close to the You club but lacks many of the benefits. Those holding out for the long trek to the Commonwealth club – and potentially the equally long trek back if they find it has indeed closed – are not happy about this discussion of the Norway club, and there are accusations of treachery. It’s obvious by now that the show is being run by certain prominent egos and if they would just stop shouting long enough to listen to what the majority are saying, it would be obvious that the decision to go back into the You club could have been made a while ago, but the bickering continues and friendships are coming under strain.
The Scots in particular didn’t want to leave the You club in the first place and are now wondering why they are actually in the group of 100 anyway. They’re having a bickering separately about whether to abandon the group and go back into the You club or to insist on the Norway club. The one thing they agree they are not up for is the Commonwealth club.
At this point it is not at all obvious whether the group will stay together, how much it will fragment if it doesn’t, let alone make a sensible decision within a useful time frame. This particular contributor, realising that being a member of the 100 is not proving particularly enjoyable and is talking to the doorman, asking about individual membership of the You club. Realising that she is massively over-invested in the 100, she has been on the phone to her financial advisors to get her exposure down from way over 50% to about the 6% of the global membership that the 100 represent. The good news from her advisor is that she’s now protected: whatever the other 99 eventually decide to do, if they trek to the Commonwealth club and it all ends in tears, she won’t go down with the ship and has options.
I came to the conclusion 6 months after the referendum that it did not reveal a will of the people one way or another. You mention the Condorcet Paradox and assume that it applies here. It may not. Also Condorcet Criteria is one of the tests for measuring any electoral system. If there is a single real option which is more popular than all other options when compared directly in pairs, then that option is the will of the people. It may well be very few voters first choice, but is a compromise. The EEA Norway option is that compromise..
Nobody has actually broached the subject- but given that we have known everything concerning Condorcet’s work for a long time and it must be required reading for all PPE graduates and every politician interested in psephology- why then was it decided to have a referendum, why was the question only binary and who could possible have thought that given no real information on the issues that such a referendum could have turned out anything other than close-run to this extent? So the question that arises is why did Cameron call such a referendum? Was he under pressure, as I have heard suggest, so he wanted to escape from those powerful influences concerned about the imminent EU legislation concerning tax havens? Was he stupid? A third option such as Norway was always there, a fourth such as the Swiss path too where further plebiscites could have been held calmly and well informed, concerning aspects such as Schengen and its distinction from non EU immigrants’ movement and immigrants with or without job offers. Yet nobody tabled these at the time- ALL politicians squawked and ran aroundlike headless chickens not knowing what to do. Project fear treated the people like idiots just confirming their view that politicians treated the voting public with nothing but contempt.
Condorcet is quite clear- provide the people with ALL information clearly and honestly and they will reach the right conclusion in the large majority of cases. This was not done, neither in the media nor by Parliament nor by the Remain or Leave factions.
